The code came into operation on 1 December 2022 and revisions to the code will become operative on 1 September 2024.

A Fair Jobs Code pre-assessment certificate is issued to suppliers and businesses that have a history of complying with existing:

  • industrial relations
  • workplace health and safety laws

Pre-assessment certificate applications can be made through the Fair Jobs Code portal.

Who can apply for a pre-assessment certificate?

Suppliers and businesses can apply for a pre-assessment certificate at any time.

Suppliers and businesses do not need to have a specific tender or grant application in progress to apply.

What documents are required?

Pre-assessment certificate checklist:

  • Australian Business Number
  • corporate structure details
  • evidence of incorporation as a company or business operation
  • for companies - details of all company directors
  • extract from relevant register
  • Worksafe (or equivalent) certificate of currency
  • employment related compliance breaches, if applicable such as an:
    • adverse ruling or
    • enforceable undertaking or
    • provisional improvement notice
  • evidence of corrective action against a compliance breach, if applicable such as:
    • compensation to affected workers
    • reinstatement of affected workers
    • new policies and procedures
  • main industry that the supplier or business operates in
  • full-time equivalent current employed in the business

First time applicant

The application process has two steps:

  1. register as an applicant – click on ‘Not a member’ on the Log In screen
  2. apply for a pre-assessment certificate

Password requirements for the Fair Jobs Code portal

Passwords must include:

  • 13 characters
  • one uppercase letter
  • one lowercase letter
  • one number
  • one special character

Reset passwords

Reset passwords by accessing the Fair Jobs Code portal registration screen and clicking the ‘Forgot Password’ button.

Trouble shoot problems with login

Try resetting the password by clicking the ‘Forgot your password’ link on the Login page.

If this doesn’t work, contact the Fair Jobs Code Unit.

Sharing login details

Access is granted to one email address per registration. If another person requires access, contact the Fair Jobs Code Unit.

Email confirming application submitted

An automated email is sent confirming that an application has been submitted.

If an applicant believes that they submitted an application, but have not received an email:

How is a pre-assessment certificate application assessed?

The Fair Jobs Code Unit:

  • assesses applications
  • may ask for more information
  • determines eligibility

Applicants will be able to submit further information if an application:

  • is incomplete
  • requires further information

The Fair Jobs Code Unit will seek to notify the outcome of a pre-assessment certificate application within 30 business days.

Assessments will consider all information provided by the supplier or business. A due diligence check of compliance history over the past 3 years will be undertaken for laws and regulations pertaining to:

  • employment
  • industrial relations
  • workplace health and safety

Requesting a review of a decision

An applicant or certificate holder may request a review if:

  • the Fair Jobs Code Unit declines a pre-assessment certificate application
  • a pre-assessment certificate is revoked

Requests for review must be submitted within 30 business days of receiving a decision.

To request a review, log into the Fair Jobs Code Portal and click on the ‘Review Decision’ icon on the home page. Select the relevant application or revoked certificate(s) and then click the continue button to submit a review decision form.

A senior officer from the Department of Jobs, Skills, Industry and Regions will conduct an independent internal review.

An applicant or certificate holder will be able to provide extra information or materials for consideration in the internal review.

The applicant or certificate holder will be advised of the outcome of the internal review.
